1. Acceptance of Terms

By accessing or using the Inuka! Angaza Kura platform ("Service"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Service. These terms constitute a binding legal agreement between you and Inuka! Angaza Kura.

2. Use of the Service

You may use the Service for lawful civic purposes, including discovering alternative candidates, observing elections, filing incident reports, and accessing published investigations.

3. Accounts

Some features of the Service require an account. When creating an account, you agree to:

• Provide accurate, complete, and current information.
• Maintain the security of your password and notify us immediately of any unauthorised access.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these terms.

4. User-Generated Content

When you submit nominations, incident reports, voter experience responses, or any other content ("User Content"), you represent and warrant that:

• The content is accurate and submitted in good faith.
• You have the right to submit the content and any media attachments.
• The content does not violate any applicable laws or third-party rights.

By submitting User Content, you grant the platform a non-exclusive, royalty-free licence to publish, display, and use that content on the platform for the purpose of promoting electoral accountability.

5. Prohibited Conduct

You must not:

• Submit false, misleading, or defamatory content about any individual or organisation.
• Impersonate any person or entity.
• Use the platform to harass, threaten, or intimidate candidates, observers, or other users.
• Attempt to gain unauthorised access to any part of the platform or its infrastructure.
• Scrape, harvest, or systematically collect data without written permission.
• Use automated bots or scripts to interact with the platform.
• Circumvent any security, rate-limiting, or access control measures.
• Use the platform for commercial advertising or spam.

6. Nominations & Candidates

Candidate profiles on this platform are based on community nominations. We do not endorse any candidate and make no representation as to their fitness for office. Nominations are subject to review and may be removed if they are found to be inaccurate, defamatory, or submitted in bad faith.

7. Incident Reports

Incident reports submitted through the platform are the responsibility of the submitting observer. Inuka! Angaza Kura will make reasonable efforts to verify reports before publishing, but does not guarantee the accuracy of any individual report. Verified reports become part of the public record and may be referenced in editorial investigations. Submitting a false incident report in order to harm an individual or disrupt an election constitutes a violation of these terms and may be reported to relevant authorities.

8. Intellectual Property

All platform content created by Inuka! Angaza Kura — including logos, designs, editorial investigations, and software — is the intellectual property of Inuka Kenya Ni Sisi! and may not be reproduced without written permission. User Content remains owned by the submitting user, subject to the licence granted in Section 4.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We make no representations about the accuracy or completeness of any content on the platform.

10. Limitation of Liability

To the fullest extent permitted by law, Inuka! Angaza Kura shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to reputational harm arising from published incident reports or candidate profiles.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these terms or if we are required to do so by law. You may terminate your account at any time by contacting us at hello@angazakura.ke.

12. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

13. Changes to Terms

We may revise these Terms at any time. We will notify you of material changes via the platform or email. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
